Overview - ESI Registration

The government introduced the Employee State Insurance (ESI) scheme to provide social security for Indian workers. Managed by the Employee State Insurance Corporation (ESIC), an autonomous body under the Ministry of Labour and Employment, Government of India, the scheme ensures workers’ welfare.

Under the ESI scheme, both employers and employees contribute a percentage of the employee’s wages towards the fund each month. Workers covered by the ESI Act are entitled to a wide range of benefits, including medical, financial, and other forms of assistance, offering comprehensive protection in times of need.

Who is Eligible for ESI Registration?

As per the official notification, the following entities are covered under the ESI Act (Section 1(5)):

State Government-Affiliated Entities:

  • Retail outlets
  • Dining establishments or hotels primarily engaged in sales
  • Movie theatres, including preview facilities
  • Road transportation-related establishments
  • Newspaper organizations (exempt from the Factory Act)
  • Private healthcare facilities
  • Private educational institutions
  • Casual workers employed by Municipal Corporations or Bodies

These entities must register with the Employee State Insurance Corporation (ESIC) if they employ 10 or more individuals.

Central Government-Affiliated Entities:

The Central Government has expanded the scope of the ESI Act to cover the following:

  • Retail outlets
  • Hotels and dining establishments
  • Road transportation-related establishments
  • Cinemas, including preview theatres
  • Newspaper organizations
  • Businesses involved in:
    • Insurance
    • Non-Banking Financial Companies (NBFCs)
    • Port trusts
    • Airport authorities
    • Warehousing

ESI registration is mandatory for these central government entities if they employ 20 or more individuals.

Advantages of ESIC Registration

ESI and PF registration offer employees a comprehensive range of benefits that ensure their health, financial security, and support for their families. The key benefits of ESI registration include:

  • Sickness Benefit: Employees are entitled to receive 70% of their wages for up to 91 days per year during certified sickness periods.
  • Extended Sickness Benefit: For certain long-term or severe illnesses, employees can receive 80% of their wages for up to two years.
  • Enhanced Sickness Benefit: Employees undergoing sterilization are provided full wage compensation during their recovery period, with 7 days for Vasectomy and 14 days for Tubectomy.
  • Medical Benefits: Employees and their families are eligible for comprehensive medical care, ensuring their well-being and access to necessary treatment.
  • Retired Medical Benefits: Retired employees and their spouses are entitled to continued medical benefits by paying an annual premium of Rs. 120.
  • Maternity Benefit: Female employees are entitled to receive full wages as maternity benefits for 26 weeks, extendable by an additional month, ensuring financial stability during childbirth.
  • Dependents’ Benefit: In the unfortunate event of an employee’s death due to an employment injury, 90% of the employee’s wages will be provided as a monthly payment to their dependents.
  • Temporary Disablement Benefit: Employees suffering from employment-related injuries are entitled to 90% of their wages as a benefit for the duration of their temporary disability.
  • Permanent Disablement Benefit: For permanent disabilities, employees will receive 90% of their wages as a monthly payment based on the loss of earning capacity, as assessed by a Medical Board.
  • Funeral Expenses: A fixed sum of Rs. 15,000 is provided to the dependents or the individual responsible for the last rites to help cover funeral expenses.

Documents Required for ESI Registration

For the online ESI registration process, businesses are not required to submit physical documents. However, the following documents need to be uploaded during the online registration:

  1. Business Registration Proof:
    • Factories Act Registration Certificate
    • Shops and Establishment Act Registration Certificate
    • Establishment Incorporation Certificate, applicable as per the entity type (e.g., Company Registration Certificate for companies, Partnership Deed for partnership firms)
    • GST Registration Certificate (if applicable)

2. Company’s Founding Documents:

    • Memorandum of Association (MoA)
    • Articles of Association (AoA)

3. Establishment’s Address Proof:

    • Recent utility bill (electricity, gas, or telephone, not older than three months)
    • Rental agreement for the establishment’s premises
    • Property tax receipt for the establishment’s location

4. Employee Details:

    • Comprehensive list of all employees at the establishment
    • PAN cards of the business and all employed individuals

5. Employee Compensation Details: Information on the salary/wages of all employees

6. Banking Information: A cancelled cheque from the company’s bank account

7. Company Leadership Details:

    • List of the company’s directors
    • List of the company’s shareholders

8. Employee Attendance Register: Record of employee attendance

ESIC Registration Process Online

Previously, the ESIC registration was a manual process, but it is now fully online. Below are the steps involved in the ESIC Registration process:

Step 1: Log in to the ESIC Portal

  • The employer needs to register on the ESIC portal.
  • To start the registration, the employer should click on the ‘Employer Login’ option on the homepage of the portal.
  • On the next page, click on the ‘Sign Up’ button.

Step 2: Confirmation Email

  • After clicking the ‘Sign Up’ button, the employer must fill out and submit the registration form.
  • Once the form is submitted, the employer will receive a confirmation email sent to the registered email ID and mobile number.
  • This email will contain the username and password for logging in and completing the registration as an employer and employee under the ESIC scheme.

Step 3: Employer Registration Form-1

  • After receiving the confirmation email, the employer should log in to the ESIC portal using the provided username and password.
  • This will redirect the employer to the ‘New Employer Registration’ page.
  • Select the ‘Type of Unit’ from the drop-down list and click on the ‘Submit’ button.
  • The ‘Employer Registration – Form 1’ will appear, where the employer needs to fill in the relevant details such as the unit, employer information, factory/establishment details, and employee details.
  • Once the form is completed, click on the ‘Submit’ button to proceed.

Step 4: Payment for Registration

  • After submitting the ESI Registration Form 1, a message will appear on the screen to make the payment for the advance contribution.
  • Click on the ‘Pay Initial Contribution’ link to proceed.
  • The system will display the initial contribution amount. Select the ‘Online’ payment option and click on ‘Submit’.
  • A Challan Number will be displayed, which needs to be noted down. Then, click on ‘Continue’.
  • The ‘Payment Gateway’ page will appear, where the employer must choose the preferred payment method and enter the payment amount.

Step 5: Registration Letter

  • Upon successful payment of the six-month advance contribution, the system will generate a Registration Letter (C-11).
  • The employer will receive the C-11 Registration Letter via email, which will include a 17-digit Registration Number issued by the ESIC department.
  • This Registration Letter (C-11) serves as the official proof of the employer’s registration with ESIC.

Compliances After ESIC Registration

Once an establishment is registered under ESIC, it must adhere to the following compliance requirements:

  • Attendance Register: Maintain a detailed record of employees’ attendance.
  • Wages Register: Keep a comprehensive register of wages paid to workers.
  • Inspection Book: Maintain a book for inspections conducted within the establishment.
  • Monthly Returns and Challans: Submit the monthly return and challan on or before the 15th of the succeeding month.
  • Accident Register: Maintain a record of any accidents that occur within the premises.

Returns to Be Filed After ESIC Registration

Following ESIC registration, employers are required to file ESI Returns twice a year. The following documents are necessary for filing the returns:

  • Attendance Register: A record of employee attendance.
  • Form 6 – Register: A specific form to be filed for compliance.
  • Wages Register: A register detailing the wages paid to employees.
  • Accident Register: A record of any accidents occurring on the premises.
  • Monthly Returns and Challans: The required documentation of monthly contributions and payments.
