Overview of LMPC Registration in India

The Legal Metrology Packaged Commodities (LMPC) Rules, 2011 regulate the packaging, sale, and distribution of pre-packaged commodities in India. This law ensures compliance with standard labeling, weight, and measurement regulations to protect consumers.

Certain industries, such as food, pharmaceuticals, and cosmetics, must adhere to additional sector-specific regulations (e.g., the Drugs & Cosmetics Act, 1940 for pharmaceutical products).

Who Needs LMPC Registration?

Any importer bringing pre-packaged goods into India for sale or distribution must obtain LMPC Importer Registration under Rule 27 of the LMPC Rules, 2011.

This registration serves as official notification to the government and customs authorities about the pre-packaged products being imported.

Common Terms for LMPC Registration

  • Importer Registration under Rule 27 (Technical Name)
  • Legal Metrology Certificate
  • Importer Registration under Legal Metrology
  • LMPC Certificate (Customs Authorities’ Term)

Types of LMPC Certificates

Under the Legal Metrology Packaged Commodities (LMPC) Rules, 2011, there are two types of LMPC registrations based on the nature of business operations:

1️.LMPC Importer Registration (Rule 27)
Required for importers who bring pre-packaged commodities into India for sale or distribution without any additional packaging or labeling modifications.

2️. LMPC Packer & Manufacturer Registration (Rule 27)
Required for manufacturers or packers who either:

  • Produce and package goods themselves.
  • Outsource manufacturing to a third party and package the products under their own brand.

Mandatory Information for LMPC Compliance

To comply with the Legal Metrology Packaged Commodities (LMPC) Rules, 2011, the following details must be included on pre-packaged commodities:

  1. Manufacturer, Importer, and Packer Information
  • The name and address of the manufacturer, packer, or importer must be clearly mentioned on the package.
  • If manufacturing and packaging are done by different companies, both names and addresses must be declared separately (not applicable to food products under the Food Safety and Standards Act).
  • A generic name of the product must be provided.
  • The Maximum Retail Price (MRP) must be clearly displayed, inclusive of all taxes.
  • The manufacturing, packaging, or import date, including the month and year, must be mentioned.
  • The expiry date (if applicable) must be stated with the month and year.
  • The best before period can also be included for consumer awareness.
  • Quantity, ingredients (if applicable), and a customer helpline for complaints must be provided.

Documents Required for LMPC Registration

To obtain LMPC Registration, the following documents are required:

  1. Business Entity Proof
  • For Private Limited, OPC, Section 8, or Public Limited Companies:
  • Certificate of Incorporation
  • Memorandum of Association (MOA) & Articles of Association (AOA)
  • For Limited Liability Partnership (LLP):
  • Certificate of Incorporation
  • LLP Deed
  • For Partnership Firms:
  • Partnership Deed
  • For Proprietorship Firms:
  • GST Certificate / Trade License / Gumastha License
  1. Owner’s Identity Documents
  • For Private Limited, OPC, Section 8, or Public Limited Companies:
  • PAN & Aadhaar of all Directors
  • For LLP & Partnership Firms:
  • PAN & Aadhaar of all Partners
  • For Proprietorship Firms:
  • PAN & Aadhaar of the Owner
  1. Import-Export Code (IEC)
  • A valid Import Export Code (IEC) issued by the Directorate General of Foreign Trade (DGFT).
  1. GST Registration Certificate
  • A copy of the GST Registration Certificate of the entity.
  1. List of Importing Goods
  • A detailed list of all pre-packaged commodities being imported.

Prohibitions Under the Legal Metrology Act

  • A person must have a valid LMPC Certificate issued by the appropriate authority to manufacture, sell, repair, or offer for sale any weights or measures.

  • Exception: A manufacturer does not need a separate legal metrology registration license to repair his own weights or measures in a state other than the one where they were manufactured.

Rules Established Under the Legal Metrology Act, 2009

The Legal Metrology Act, 2009 governs the use of weighing and measuring devices in India. The Act includes several rules to ensure accuracy, transparency, and standardization. Below are the key regulations:

  1. The Legal Metrology (General) Rules, 2011
  • Covers approximately 40 different types of weighing and measuring devices, including:
  • Electronic weighing instruments
  • Weighbridges
  • Fuel pumps
  • Water meters
  • Sphygmomanometers (Blood Pressure Monitors)
  • Clinical thermometers
    State Government authorities inspect these devices periodically using standardized weights and measures.
  1. The Legal Metrology (Packaged Commodities) Rules, 2011
  • Mandates labelling requirements for pre-packaged goods, which must include:
  • Manufacturer/Packer/Importer’s Name & Address
  • Country of Origin (for imported items)
  • Common or Generic Name of the Commodity
  • Net Quantity
  • Date of Manufacture/Packing/Import
  • Maximum Retail Price (MRP, inclusive of all taxes)
  • Consumer Care Details
  1. The Legal Metrology (Approval of Models) Rules, 2011
  • Establishes standards for pre-packaged goods, specifying the declarations and markings required on products.
  1. The Legal Metrology (National Standards) Rules, 2011
  • Defines the base units of measurement (length, mass, time, etc.) and verification norms for standard measurements.
  1. The Legal Metrology (Numeration) Rules, 2011
  • Specifies the format for writing numbers and numeration in legal documents and product labels.
  1. The Indian Institute of Legal Metrology Rules, 2011
  • Governs the Indian Institute of Legal Metrology (IILM), Ranchi, which trains Legal Metrology Officers (LMOs) from various states and Union Territories.

  • Defines the curriculum, functions, and admission criteria for training programs.
  1. The Legal Metrology (Government Approved Test Centre) Rules, 2013
  • Regulates the Government Approved Test Centres (GATCs), which private individuals operate under State Government supervision.

  • Defines permissible testing instruments, including:
  • Water meters
  • Sphygmomanometers
  • Clinical thermometers
  • Automatic rail weighbridges
  • Tape measures
  • Non-automatic weighing instruments (Class-III and Class-IIII, up to 150 kg)
  • Load cells
  • Beam scales
  • Counter machines
  • Various categories of weights
