Overview - IJCEPA Registration

The India-Japan Comprehensive Economic Partnership Agreement (IJCEPA) was signed in October 2022 and came into effect on January 1, 2023. This agreement enhances bilateral trade by providing exporters and importers from both countries with reduced or zero tariffs on specified goods and services. The IJCEPA Certificate of Origin allows businesses to claim preferential tariff rates agreed upon under the IJCEPA framework.

This certificate helps businesses by reducing customs duties on eligible goods, making trade between India and Japan more cost-effective. The agreement applies to the territories of both nations, including their territorial seas, airspace, and exclusive economic zones, in accordance with national and international laws, such as the UN Convention on the Law of the Sea

Why is the IJCEPA Registration Important?

Obtaining an IJCEPA Certificate is crucial for businesses looking to take advantage of lower tariffs and seamless trade opportunities between India and Japan. Without proper registration, businesses cannot access preferential benefits, potentially impacting cross-border trade and overall economic growth.

Eligibility Criteria for IJCEPA Registration

To qualify for IJCEPA Registration, goods must meet specific preferential tariff criteria. These are divided into two categories:

1️. Goods Wholly Obtained or Entirely Produced in Either Party: To qualify under this category, the goods must be completely sourced or produced within India or Japan. The eligible items include:

 Natural Resources & Raw Materials: Minerals and other naturally occurring substances extracted or taken in India or Japan. Goods taken from the seabed or subsoil beyond territorial waters, where both countries hold exploitation rights under the UN Convention on the Law of the Sea.

Agricultural & Animal-Based Goods 

  • Live animals born and raised in India or Japan.
  • Hunted, trapped, or fished animals obtained within the territories of either country.
  • Products from live animals, such as dairy, honey, or wool, sourced in India or Japan.
  • Plants and plant products, including fruits, flowers, vegetables, trees, seaweed, and fungi, harvested in India or Japan.

 Industrial & Recovered Goods

  • Scrap and waste materials generated from manufacturing, processing, or consumption, fit only for disposal or material recovery.
  • Parts or raw materials recovered from discarded items that can no longer serve their original purpose.
  • Goods produced using the above materials, ensuring they are sourced entirely from India or Japan.

 Marine & Fishing Products

  • Sea-fishing products and other goods taken by vessels registered in India or Japan, outside the territorial seas of both parties.
  • Goods produced on factory ships registered in either country, using materials sourced from the high seas.

2️. Goods Not Wholly Produced in Either Party

For goods that contain materials from outside India or Japan, they must meet the following criteria:

  1. Qualifying Value Content (QVC) Requirement
  • The product must have a minimum local content of 35%, meaning that at least 35% of its value must originate from India or Japan.
  1. Tariff Classification Rule
  • All non-originating materials used in the production of the goods must undergo a change in tariff classification at the 6-digit level of the Harmonized System (HS).

Objectives of the IJCEPA Registration

The India-Japan Comprehensive Economic Partnership Agreement (IJCEPA) is designed to strengthen trade and investment between the two nations. Its key objectives include:

  1. Facilitating Bilateral Free Trade – Promoting seamless trade between India and Japan by reducing tariffs and trade restrictions.
    2. Enhancing Investment Opportunities – Encouraging cross-border investments to boost economic growth.
    3. Improving Business Environment – Streamlining trade regulations to support businesses and economic stability.
    4. Ensuring Intellectual Property Protection – Strengthening safeguards for intellectual property rights to foster innovation and cooperation.

Documents Required for IJCEPA Registration

To apply for the IJCEPA Certificate of Origin, exporters must provide the following documents and information:

1️. Exporter & Importer Details

  • Exporter’s Details – Name, address, and country of origin.
  • Importer’s Details – Name, address, and country of destination.

2️. Shipping & Logistics Information

  • Port Details – Loading port, transit port, and discharging port.
  • Shipment Details – Name of vessel or flight number.
  • Date of Shipment – Bill of Lading or Airway Bill date (for retroactive issuance).

3️. Product & Classification Information

  • Item Number, Marks & Numbers – Number and type of packages.
  • HS Code Classification6-digit tariff classification number based on HS 2007.
  • Product Description – Detailed description of each consigned good.
  • Preference Criterion – Proof that the goods meet the IJCEPA preferential trade rules.
  • Quantity of Goods – Unit and total weight or volume.
  • Invoice Number & Date – Invoice reference for each consigned good.
  • Third-Country Invoicing – If the invoice is issued by a different entity located outside India or Japan.

4️. Legal & Compliance Documents

  • DSC (Digital Signature Certificate) – For authentication and online submissions.
  • IEC (Import-Export Code) – Issued by the DGFT for export-import activities.
  • Manufacturer’s Declaration – On the company’s letterhead confirming product origin.
  • Purchase Order from Importer – Proof of transaction between buyer and seller.
  • Self-Declaration – Affirmation of compliance with IJCEPA rules.

Procedure for Obtaining the IJCEPA Certificate

To secure an IJCEPA Certificate of Origin, follow these steps:

1️. Application Submission: The exporter must submit an application to the authorized issuing authority using a Digital Signature Certificate (DSC) and a valid Import-Export Code (IEC).

2️Document Submission: All required documents and details must be provided along with the application, including exporter/importer information, invoice details, product classification, and declarations.

3️. Payment of Fees: The applicant must pay the applicable fees as per the regulatory guidelines.

4️ Verification & Issuance: Once the submitted documents are reviewed and verified, the IJCEPA Certificate is issued in the name of the exporter, allowing them to claim preferential tariff benefits under the agreement.
