Overview - FSSAI Renewal

All food business operators are required to renew their FSSAI license prior to its expiration date. Unlike State and Central food licenses, which can be renewed up to 60 days before expiry, FSSAI Basic Registration renewals must be completed within 30 days after the license has expired. 

If a food operator fails to renew their license on time, they may be subject to a fine of Rs. 100 per day until the license is renewed. Additionally, the FSSAI authorities have the authority to revoke a food license suo moto if the renewal is not completed within the specified period. The validity period of a food license can range from one to five years, depending on the size and nature of the food business.

In India, the Food Safety and Standards Authority of India (FSSAI) plays a crucial role in ensuring the quality and safety of food products. This regulatory body mandates that food businesses obtain the appropriate FSSAI license or registration based on their qualifications, and they must ensure its timely renewal to remain compliant.

Types of FSSAI Renewal

  1. Basic FSSAI License: Also referred to as “FSSAI License Renewal Form A,” this renewal is available to food businesses that meet the basic registration criteria, which includes having a turnover of less than Rs. 12 lakhs. The renewal fee ranges from Rs. 100 to Rs. 500, depending on the number of years chosen.
  1. State FSSAI License: Known as “FSSAI License Renewal Form B,” this license is applicable to food operators that meet state licensing requirements and have an annual turnover between Rs. 12 lakhs and Rs. 20 crore.
  1. Central FSSAI License: Issued by the Food Safety and Standards Authority of India under the Ministry of Health and Family Welfare, Government of India, the central FSSAI license is mandatory for businesses with an annual revenue exceeding Rs. 20 crore, those operating in multiple states, or having multiple locations within a single state.
 

Eligibility Criteria for FSSAI License in India

Annual Turnover: State License: INR 12 lakhs to INR 20 crore, Central License: Above INR 20 crore

Production Capacity: State License: Up to 2 metric tons per day (food), or 50,000 liters per day (dairy), Central License: Over 2 metric tons per day (food), or 50,000 liters per day (dairy)

Type of Business: State License: Operations confined to a single state, Central License: Includes e-commerce, import-export, and activities across multiple states

Area of Operation: State License: Operates within a single state, Central License: Operates across multiple states

Storage Capacity: State License: Up to 50,000 metric tons, Central License: Exceeds 50,000 metric tons

FSSAI License Renewal Documents Required

  • Submit proof of the business, such as a gas bill, phone bill, or electricity bill.

  • Provide the No Objection Certificate (NOC) issued by relevant authorities like the health department, panchayat, municipality, etc.

  • If the business premises are rented, include the owner’s NOC and the rental agreement.

  • Furnish proof of the Food Business Operator’s (FBO) identity, such as a passport, Aadhar card, driving license, voter ID, or PAN card.

FSSAI License Renewal Process

Step 1: As per the Food Safety and Standards Act, Regulations, and Laws, the first and crucial step in renewing an FSSAI license is to fill out Form A (Basic FSSAI Registration Form) or Form B (Central or State FSSAI Registration Form). Attach a copy of the previous license and submit the necessary self-attested supporting documents.

Step 2: Submit the completed application for FSSAI license renewal through the official online portal at https://foscos.fssai.gov.in/.

Step 3: The Food Department’s review team will thoroughly verify the submitted documents and may raise queries if additional clarification or information is needed.

Step 4: An authorized FSSAI inspector will conduct a comprehensive inspection of the food business premises, along with an assessment of the establishment’s policies and adherence to standards.

Step 5: Following the application review and onsite inspection, the FSSAI authority will issue the renewed food license to the applicant.

Validity and timeline of FSSAI license renewal

The validity of a renewed FSSAI license depends on the duration selected by the applicant and the fee paid at the time of renewal. You can choose to renew your FSSAI license for a period ranging from 1 to 5 years. It is advisable to initiate the renewal process at least 30 days prior to the license’s expiry date. If the renewal is not completed before expiration, you can still apply for renewal by paying a late fee or penalty.
