Overview - FSSAI STATE Registration

The Food Safety and Standards Authority of India (FSSAI) is a key government agency responsible for regulating the food industry across India. It has established numerous guidelines and regulations to promote food safety nationwide. Currently, every food business operator (FBO) in India must obtain a valid FSSAI State License to legally operate.

Operating without a valid food license is a criminal offense under the FSS Act, 2006. FSSAI carries out its functions in accordance with this Act and under the guidance of the Ministry of Health & Family Welfare.

Who Needs an FSSAI State License?

Medium-sized food businesses engaged in manufacturing, processing, packaging, storage, distribution, or sales must obtain an FSSAI State License. Specifically, this applies to businesses in the following categories:

  • Operating within a single state with an annual turnover between Rs 12 lakhs and Rs 20 crores.
  • Handling proprietary foods.
  • Producing or processing vegetable oils via solvent extraction within the specified turnover range.
  • Hotels rated up to 4 stars.
  • Dairy facilities, including Milk Chilling Units, with a capacity of 500 to 50,000 liters.
  • Storage facilities with an annual capacity below 50,000 metric tons.
  • Slaughterhouses processing more than 2 and up to 50 large animals, or handling over 10 and up to 150 small animals, or slaughtering 50 to 1,000 poultry birds daily.
  • Food processing units, including re-packing facilities, with a daily capacity ranging from 100 kg to 2 metric tons.

Documents required for APTA Certificate Registration

  • Details of key management personnel, including Directors, Partners, Proprietors, and Executive Members of the Society, along with their complete addresses and contact information.
  • Recent passport-sized photographs of the individual applying for the license.
  • Valid identification and address proof of the applicant.
  • Copy of the applicant’s PAN card.
  • Property documents if the business premises are owned by the applicant.
  • Rent agreement and No Objection Certificate (NOC) from the landlord if the premises are rented.
  • Details of raw material suppliers.
  • Duly completed and authenticated Form B by the applicant.
  • List of machinery installed at the facility.
  • No Objection Certificate (NOC) from the local municipality.
  • Information on food categories and the proposed food products to be manufactured at the facility.
  • Import Export Code issued by the Directorate General of Foreign Trade.
  • Form IX.
  • Authorization letter including the name and address of the responsible individual.
  • Food Safety Management System (FSMS) documentation.

Process for Obtaining FSSAI State License

  1. Arrange the required documents and complete the application process using Form B.
  2. Submit the application along with the documents to the licensing authority via the online portal FOSCOS.
  3. Complete the process by paying the prescribed standard application fee.
  4. FSSAI officials will conduct a detailed review and scrutiny of the application and supporting documents.
  5. If necessary, an on-site inspection will be carried out to assess compliance at the business premises.
  6. Upon successful verification, the licensing authority will grant the State FSSAI License. (Note: The license may be revoked if the business is found to be non-compliant.)
  7. Once the license is obtained, the business owner can legally commence their operations.
