Overview - RCMC Registration

The Registration-Cum-Membership Certificate (RCMC) is a mandatory authorization document required for the import or export of restricted goods, as outlined in the Foreign Trade Policy (FTP). It is generally issued by Export Promotion Councils (EPCs), Commodity Boards, or Export Development Authorities designated by the Director General of Foreign Trade (DGFT) for specific categories of products.

The RCMC also serves as official proof of an exporter’s registration or membership with the respective council or board. Eligibility for RCMC Registration Online

To apply for the Registration-Cum-Membership Certificate (RCMC) online, businesses must fulfill certain eligibility criteria:

  1. Exporter or Merchant Trader

The applicant must be actively engaged in the export or import of goods. It is essential to have an Import Export Code (IEC) issued by the Director General of Foreign Trade (DGFT). The IEC is a fundamental requirement for any business involved in cross-border trade.

  1. Declaration of Business Main Line

Exporters must declare their primary line of business. For example, those dealing in tea or coffee must register with the relevant Tea or Coffee Promotion Board. If there is no specific Export Promotion Council (EPC) or commodity board for the products they handle, this must be stated clearly in the application.

  1. Approval from FIEO

If no specialized council or board is available for the commodities in question, exporters must seek authorization from the Federation of Indian Export Organisations (FIEO). Approval from FIEO is also necessary when applying for RCMC registration in such cases.

Types of Exporters/Importers Eligible for RCMC

The RCMC is available to a wide range of businesses engaged in export/import activities. Categories include:

  1. Ordinary Membership: Ideal for businesses newly entering the export/import domain, offering basic membership benefits.

 

  1. Associate Membership: Designed for experienced exporters/importers with a well-established business. This membership involves a higher fee, inclusive of applicable GST.

 

  1. Premier Trading House (PTH) Membership: Suitable for companies with a notable share in India’s total exports and a significant contribution to international trade.

 

  1. Star Export House (SEH) Membership: Awarded to companies showing consistent export growth and earning substantial foreign exchange.

 

  1. Trading House (TH) Membership: For firms with active involvement in foreign trade and a minimum annual turnover of INR 100 crores.

Documents Required for RCMC Registration

The following documents must be enclosed with the Registration-Cum-Membership Certificate (RCMC) application:

  1. Duly Filled Application Form – A completed and signed RCMC application form.

 

  1. Import Export Code (IEC) – Self-attested copy of the IEC issued by the relevant Regional Licensing Authority.

 

  1. Permanent Account Number (PAN) – Self-attested copy of the company’s PAN card, issued by the appropriate authority.

 

  1. Membership Fee – Payment of the applicable membership fee to the Services Export Promotion Council (SEPC) via: Demand Draft payable at New Delhi, or

 

  1. Cheque payable at any of the SEPC’s designated branches.

 

  1. Memorandum of Association (MOA) – For companies registered as Corporate/Institutional/Private Limited/Limited – a self-attested copy of the MOA.

 

  1. Partnership Deed – For partnerships and individual proprietorships – a self-attested copy of the Partnership Deed.

 

  1. Trust Deed – For trusts and institutions – a self-attested copy of the Trust Deed.

 

  1. Certificate of Office Change – A self-attested copy of the certificate issued by the Registrar of Companies regarding any change in the registered office address.

 

  1. Service Export Data (Last 3 Years) – Foreign exchange earnings data for the past three financial years, certified by a Chartered Accountant.

 

  1. Board Resolution or Power of Attorney – If the signatory’s name does not appear in the IEC, MOA, Partnership Deed, or Trust Deed, a self-attested copy of the board resolution or power of attorney authorizing the signatory must be submitted.

 

  1. GST Registration Certificate – A self-attested copy of the company’s GST registration certificate.

Validity of RCMC T he Registration-Cum-Membership Certificate (RCMC) is valid for a period of five years. Its validity begins from April 1 of the licensing year in which it is issued and remains active until March 31 of the fifth year.

Documents Required for RCMC Registration

To apply for RCMC, the following documents must be submitted along with the application form:

  • Import Export Code (IEC): Issued by the relevant Regional Licensing Authority.
  • Permanent Account Number (PAN): Issued by the competent tax authority.
  • Memorandum of Association (MOA): Applicable to corporate, institutional, private limited, or limited companies.
  • Partnership Deed: Required for partnership firms and individual proprietorships.
  • Trust Deed: For trusts, institutional, or corporate entities.
  • Registered Office Certificate: Issued by the Registrar of Companies in case of any change in the registered office address.
  • Foreign Exchange Earnings Data (last 3 years): Certified by a Chartered Accountant.
  • Board Resolution/Power of Attorney: If the signing authority’s name is not mentioned in IEC/MOA/Partnership Deed/Trust Deed, a self-attested copy authorizing the individual to sign must be submitted.
  • GST Registration Certificate: A self-attested copy confirming GST compliance.

Compliance Requirements for RCMC

Compliance with the Registration-Cum-Membership Certificate (RCMC) is essential for exporters who wish to access various export incentives and participate in government-supported trade initiatives. Below are the key compliance obligations:

  1. RCMC Renewal

RCMC is valid for five years and must be renewed before expiration. Failure to renew the certificate on time may lead to non-compliance, resulting in disqualification from export-related schemes and benefits.

  1. Adherence to Foreign Trade Policy

Exporters must comply with all guidelines and conditions outlined in the Foreign Trade Policy (FTP) as issued by the Director General of Foreign Trade (DGFT). Non-compliance may affect eligibility for government programs and incentives.

  1. Submission of Annual Export Data

Exporters are required to submit annual export performance data to the DGFT or relevant Export Promotion Council. Failure to provide this data may lead to suspension or cancellation of the RCMC.

  1. Customs Compliance

Exporters must follow all customs laws, rules, and procedures when exporting goods. Any breach may attract penalties, delays, or legal action.

  1. Compliance with Foreign Trade Regulations

All export activities must comply with applicable trade regulations, including adherence to export control rules, international sanctions, and embargoes.

  1. Conformity to Quality Standards

Exporters are expected to meet the product quality standards and specifications laid down by the importing country to ensure market acceptance and avoid rejections.

  1. Record Maintenance

Proper record-keeping of export transactions is mandatory. Exporters must retain documentation and data as required by DGFT and produce them when requested during audits or reviews.

RCMC Registration under Export Promotion Councils

In India, 26 Export Promotion Councils (EPCs) and 9 Commodity Boards function as the authorized bodies responsible for issuing the Registration-Cum-Membership Certificate (RCMC) to exporters. These organizations have been notified by the Central Government to act as Registering Authorities for exporters dealing in specific categories of goods and services.

If an exporter’s product line does not fall under the purview of any specific EPC or Commodity Board, they can apply for an RCMC through the Federation of Indian Export Organisations (FIEO).

Registering Authorities

A Registering Authority is a body notified under the DGFT’s Appendix 2T, empowered to register importers and exporters as members by issuing the RCMC.

Criteria for EPCs as Registering Authorities

To enhance transparency, governance, and democratic participation within EPCs, the following criteria have been established:

  • Mandatory e-Voting: Electronic voting is required for electing key positions such as Vice Chairman/Vice President and members of the Executive Committee. This promotes wider and more inclusive participation.
  • Limited Tenure for Leadership:
    • The tenure of any elected Chairman/President cannot exceed two years.
    • Leadership is elected through a progression system from Vice Chairman/Vice President to Chairman/President.
    • Any individual who has previously served in these roles can contest again for Vice Chairman only after a minimum gap of four years.
  • Compliance with Government Directives:
    • EPCs serving as Registering Authorities must strictly adhere to Central Government guidelines related to the promotion and development of international trade.

Intimation of Changes in Exporter’s Business: RCMC holders are required to inform their Registering Authority within one month in case of any changes in the following:

  • Business ownership
  • Legal constitution
  • Name or address

Quarterly Reporting Requirement: Exporters must submit quarterly export details of various commodities to their respective Registering Authorities. In addition, Status Holders must also send quarterly returns to FIEO in the format prescribed by the organization.

De-Registration of RCMC: An exporter’s RCMC may be de-registered by the Registering Authority for a specified period if the conditions of registration are violated. Prior to de-registration, the RCMC holder will receive a show-cause notice from the authority and will be given a reasonable opportunity to represent their case.

Upon de-registration, the concerned Export Promotion Council (EPC) will notify all relevant Registering Authorities (RAs) about the action.

Appeal Against De-Registration: If an exporter disagrees with the de-registration decision, they may file an appeal with the Directorate General of Foreign Trade (DGFT) or an appointed officer. The appeal must be filed within 45 days from the decision. The decision of the appellate authority will be considered final.

Directives from DGFT: The DGFT can direct any Registering Authority to either register or de-register an exporter. Such directives will be issued in line with the provisions of the Foreign Trade (Development and Regulation) Act, along with the associated rules and orders under the Foreign Trade Policy (FTP).

Penalty for Violation: If an exporter violates the terms and conditions of their registration, the Export Promotion Council (EPC) can de-register them for a specified period as a penalty.

Validity of RCMC: The RCMC is valid from 1st April of the licensing year it is issued, and remains valid for five years, expiring on 31st March of the final year.
