Overview - EPR For Battery Waste

EPR for battery waste refers to the extended producer responsibility assigned to manufacturers for managing used batteries in an environmentally safe manner, thereby protecting both the environment and human health from potential hazards associated with battery substances.

The Battery Waste (Management) Rules, 2022, mandate that producers fulfill their EPR obligations by collecting used batteries and ensuring their refurbishment or recycling. These rules prohibit open-field disposal or incineration of batteries. Producers can engage recyclers, refurbishers, or authorize other entities to handle collection, recycling, or refurbishment activities.

The primary goal of EPR for battery waste is to promote environmental sustainability by encouraging the adoption of green energy solutions while minimizing reliance on conventional energy sources. As large quantities of batteries are imported and disposed of at end-of-life, the government introduced EPR to ensure responsible management of battery waste, placing duties on producers and importers to collect, recycle, and refurbish batteries responsibly.

Under the Battery Waste Management Rules, 2022, four types of batteries are categorized:

  1. Automotive batteries: Batteries used exclusively for vehicle lighting, ignition, or starting systems.
  2. Lithium-ion batteries: Batteries used in electric vehicles such as e-scooters, e-bikes, and e-cars.
  3. Industrial batteries: Batteries powering large machinery like forklifts, trucks, and industrial vehicles.
  4. Portable batteries: Batteries used to charge devices like tablets, smartphones, and other portable electronics.

Certificate for EPR for battery waste

To obtain a certificate for battery waste management, certain compliance requirements must be met. All types and quantities of batteries that are refurbished or recycled are eligible to receive certificates for waste and end-of-life batteries from registered entities.

Additionally, these certificates can be exchanged to fulfill Extended Producer Responsibility (EPR) obligations. The certificates are issued based on the weight (in kilograms) of battery waste that has been recycled or refurbished. The Central Pollution Control Board (CPCB) will generate these certificates and distribute them to recyclers or refurbishers, as applicable.

Responsibility of EPR for battery waste Producer/Manufacturer

  • Producers placing batteries on the market must adhere to stricter collection, recycling, and refurbishment targets.
  • They are required to register and periodically renew their registration through a centralized online portal.
  • A detailed Extended Producer Responsibility (EPR) action plan must be submitted to the CPCB, including information on the quantity, weight, and dry weight of battery components such as nickel, cobalt, lead, lithium, as well as plastics and paper.
  • Under the Battery Waste Management Rules, 2022, producers must submit an EPR Plan in Form 1(C) to the CPCB within three months of the rule’s publication for batteries produced during FY 2022-2023.
  • Battery manufacturers are required to incorporate a minimum percentage of recycled materials into their products.
  • For imported batteries, producers can fulfill this requirement either by exporting an equivalent amount of recycled materials or by using that amount in other manufacturing processes.

Documents Required For EPR For Battery Waste

  • Company GST Certificate
  • PAN Card of the Company
  • Corporate Identification Number (CIN) Document
  • Consent issued by SPCBs/PCCs for Air, Water, or Hazardous Waste (if the unit operates a production facility)
  • Import-Export Certificate (applicable to importers)
  • District Industries Center (DIC) Registration (if the unit is registered with DIC)

Processing of EPR Authorization For Battery Waste

  • The registration application will be processed within 15 working days.
  • A decision to grant or reject the registration will be communicated within this period.
  • If the application is found to be incomplete, such as missing documents or information, the applicant will be notified to provide the necessary details.
  • Applications will be rejected if false or irrelevant information or documents are submitted; in such cases, the application fees will be forfeited.
  • For rejected applications, fresh applications along with the applicable fees must be submitted for registration.
  • Once approved, the registration certificate, signed and sealed by a Competent Authority, will be uploaded to the Portal.
  • The portal facilitates internal processing of applications within CPCB, with the Member Secretary, CPCB, serving as the approving authority for issuing the certificate.
  • The new registration will be valid for five years from the date of issuance.
