  • ITR-7 – Applicable only if the LLP is registered as a non-profit and claims tax exemptions under Section 11 or Section 10(23C).

Audit Requirement for LLPs

LLPs must get their accounts audited if: Annual turnover exceeds ₹40 lakh OR. Total capital contribution exceeds ₹25 lakh

The audit must be conducted by a Chartered Accountant (CA), and the LLP must file Form 3CA-3CD or Form 3CB-3CD.

Due Dates for LLP ITR Filing

  • 31st July – If no audit is required.
  • 30th September – If an audit is required.

Penalties for Late/Non-Filing

  • Late Filing Penalty – ₹1,000 to ₹10,000 under Section 234F.
  • Interest on Tax Due – Charged under Sections 234A, 234B, 234C.
  • Prosecution – Repeated non-compliance can result in legal action.

Step-by-Step ITR Filing Process for LLPs

  1. Log in to the Income Tax e-filing portal using the LLP’s PAN.
  2. Select Form ITR-5 (or ITR-7 if applicable).
  3. Enter LLP details – Name, PAN, incorporation date, address, etc.
  4. Report income & expenses – Declare revenue, expenses, and deductions.
  5. Attach audit report (if applicable).
  6. Verify return – Using DSC (Digital Signature Certificate) (mandatory for LLPs).
  7. Submit the return.
