  • Applicants: Individuals, their legal representatives, or assignees can submit an application either independently or jointly.

To successfully register a design in India, applicants must submit the following documents:

  • Applicant’s Details: Full name and address of the applicant.
  • Applicant’s Legal Status: Clear indication of the applicant’s status — whether an individual, company, or other legal entity.
  • Startup Certificate (if applicable): Startups must provide a valid registration certificate.
  • Description of the Article: A comprehensive description of the article related to the design, along with its classification under the appropriate category.
  • Visual Representation: A minimum of four images or drawings showcasing the article from different angles must accompany the application.

Process for Design Registration

When applying for design registration in India, you can submit your application to one of the following five authorities:

  • Controller Designs Patent Office, Kolkata (Head Office)
  • Patent Office, Delhi
  • Patent Office, Ahmedabad
  • Patent Office, Mumbai
  • Patent Office, Chennai

Applications submitted to the regional offices (Delhi, Mumbai, Chennai, or Ahmedabad) are redirected to the head office in Kolkata for further processing.

Application Procedure: To file for design registration, submit Form-1 along with the following details:

  • Applicant Information:
    • Name of the applicant
    • Address of the applicant
    • Nationality of the applicant
    • If the applicant is a company or other legal entity, provide details of incorporation and legal status.
  • Fee Payment: Ensure the applicable fee is included.
  • Classification Details: Specify the class and sub-class of the article according to the Locarno Classification.
  • Article Name: State the name of the article to which the design is applied.
  • Design Representation:
    • For 2D designs: Submit two copies of the design.
    • For 3D designs: Submit two copies showing the front, back, top, bottom, and both side views.
    • Highlight the unique features distinguishing your design from existing ones.
  • Multiple Class Applications: If you’re registering the design in multiple classes, submit a separate application for each class.
  • Statement of Disclaimer or Novelty:
    • Attach a statement for elements like mechanical processes, trademarks, numbers, letters, etc.
    • Ensure each representation is signed, dated, and endorsed by the applicant or an authorized representative.

  • Examination and Approval

    • After submission, the patent office examines the application.
    • If objections are raised, they must be resolved for the application to proceed.
    • Once all objections are cleared, the patent office grants a Copyright Certificate for the design.

Validity and Renewal

  • The design registration remains valid for 10 years from the date of registration.
  • It can be extended for an additional 5 years by submitting Form-3 and a fee of Rs 2000 before the initial 10-year period expires.
