  1. Complete Assignment

The owner (assignor) transfers all rights in the trademark to the new owner (assignee). This includes the right to earn royalties, further transfer, and full control over the mark.

Example: X owns the brand ‘ABC.’ X transfers the trademark entirely to Y. After this, X has no rights to the ‘ABC’ brand.

The assignor transfers the trademark only for specific goods or services, while retaining rights for others.

Steps in the Trademark Assignment Process

  1. Filing the Application
    • The assignee (new owner), assignor (current owner), or both jointly must apply for the trademark assignment using Form TM-P.
    • This application formally requests the Registrar of Trademarks to register the assignee as the new proprietor of the trademark.
  2. Timeline for Filing
    • The application should be submitted within 6 months from the date of ownership transfer.
    • If filed after 6 months, additional late fees may apply.
  3. Special Cases: Assignment Without Goodwill or Certified Trademarks
    • If the assignment is without goodwill (restricting the assignee from using the mark on products/services already associated with the original owner) or involves a certified trademark, prior approval from the Registrar is required.
    • This approval must be sought within 6 months from the transfer date — extensions may be granted at the Registrar’s discretion.
  4. Advertisement Requirement
    • The assignment must be publicly advertised in a manner specified by the Registrar to ensure transparency and prevent public confusion.
    • Proof of this advertisement, along with the Registrar’s direction, must be submitted to confirm compliance.
  5. Registrar’s Review and Approval
    • Upon receiving the application and supporting documents, the Registrar reviews the request.
    • Once satisfied that all conditions are met, the assignee is officially registered as the new trademark owner.
    • The details of the assignment are then updated in the Trademark Register.
